ShapeSpecialist.com’s Agreement & Terms of Use |

This Web Site Hosting Service Agreement
("Agreement") is by and between
SHAPESPECIALISTS.COM , a division of P.S.O.
Inc., and you, your heirs, assigns, agents and
contractors ("You") and is effective as of the
date of electronic execution. This Agreement
sets forth the terms and conditions of Your use
of ShapeSpecialists.com Web Site Hosting ("Web
Hosting") services and represents the entire
agreement between You and ShapeSpecialists.com .
By using ShapeSpecialists.com ’s Web Hosting
services, You acknowledge that You have read,
understand and agree to be bound by all the
terms and conditions of this Agreement, along
with any new, different or additional terms,
conditions or policies which
ShapeSpecialists.com may establish from time to
time:

- This is a legal and binding
contract once I hit the SUBMIT button
below.
- I am in no way to participate in
SPAM or bulk emailing, chain letters,
or other means of unsolicited
communication with
ShapeSpecialists.com
website. I understand that this will
result in immediate termination of my
Account, and all monies paid will be
forfeited.
ShapeSpecialists.com will not be
liable for any legal or civil action
taken against any member because of
such activities. I also understand
that additional fees may be applied.
- I understand there are no
guarantees or promises made to me by
ShapeSpecialists.com
or it's Agents in regards to the
performance and percentage of sales as
a result of
ShapeSpecialists.com's services. In
addition,
ShapeSpecialists.com cannot be
held liable for members' loss of
sales, potential sales, or web hosting
fees in conjunction with acts of God,
mechanical and/or technological
failure of hardware, software, or
other peripheral equipment owned by
ShapeSpecialists.com, its affiliates, or
associate companies involved in the
delivery of web hosting services.
- The total activation costs for all
agreed services with
ShapeSpecialists.com
will be billed upon acceptance, and
then monthly hosting/maintenance fees
(subject to change with a 30 day
notice should operational costs
increase) will be billed on my monthly
anniversary date thereafter for as
long as this agreement is intact. The
Yearly Renewal Fees are due exactly
one year after the initial activation
for the Maintenance, Upgrades,
incorporation & development of new
tools to the present Web site. The
renewal fee may be different from the
original agreement if the user has
subscribed to additional websites. In
the case of multiple website
subscriptions, the user will be
charged the equivalent of their
individual agreements combined, unless
a package deal exists, at which time
the user will be charged the lesser
amount. The renewal charge will take
place on the yearly anniversary date
in which the first website was
activated.
- I understand that all the domain
names, content,
organization, gathering, compilation,
magnetic translation, digital
conversion, auto-responder, newsletter
messages and other matters related to
the Site are the Sole Property of
Prizm Solutions
Online Inc. the sole proprietor of
ShapeSpecialists.com
and EnergyDrinkNow.com and protected
under applicable copyrights,
trademarks and other proprietary
(including but not limited to
intellectual property) rights. The
copying, redistribution, use or
publication by a User of any such
content or any part of the Site is
strictly prohibited, except for
personal and/or home business use and
not for republication, distribution,
assignment, sublicense, sale,
preparation of derivative works or
other use.
- I understand and take
responsibility for all aspects of
quote preparation, order processing,
fulfillment, billing and customer
service in a timely fashion. Failure
to provide proper customer service may
result in the termination of this
agreement.
- The fees for the set up
and services will appear under the
name of Prizm
Solutions Online Inc. (Prizm
Marketing). I accept these
charges and understand that I'm
personally liable to pay the fees on a
timely manner and I and will not make
an attempt of claiming a charge back
or anything similar to avoid paying
for the services under this agreement.
In case of a
chargeback made willingly after
services have been rendered, Prizm
will report the account to a
governmental credit agency and a
presentment fee of $30 will be added
to the owing amounts per falsely
claimed charge back.
- I may request service at anytime
by emailing
support@ShapeSpecialists.com I realize
that this includes any and all billing
inquiries.
- I may cancel my Monthly Services
at anytime by sending an email to
support@ShapeSpecialists.com.
All requests for cancellations must be
made at least 10 days prior to next
billing period. It is the
responsibility of the user to ensure
that their request is sent to support
before the billing date, as no refunds
will be issued once charges are
processed.
- This is a
NON-REFUNDABLE transaction.
Once you place the order, we will
process your billing information and
begin creating your site.
